These terms and conditions for the online sale of goods and services (“Terms”) apply to the purchase and sale of products and services through https://www.bnashop.com (the “Site”). This Site is operated by the Metropolitan Nashville Airport Authority. Throughout the Site, the terms “we”, “us” and “our” refer to the Metropolitan Nashville Airport Authority. Please read these Terms carefully before accessing or using the Site. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all the Terms, then you may not access or use the Site. By visiting the Site and engaging with us to purchase items for sale on the Site, you agree to be bound by these Terms. You acknowledge and agree that these Terms are incorporated into an integral part of the Website’s Terms of Use, which apply and are enforceable with respect to your use of our Site. You should also carefully review our Privacy Policy before placing an order for products or services through this Site. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. These Terms are subject to change by us without prior written notice at any time in our sole discretion. Any changes to these Terms will be in effected as of the “Last Updated Date” referenced on the Site. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes. Metropolitan Nashville Airport Authority offers this Site, including all information, tools and services available from this Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices contained herein. Any new features or tools that are added to the current store shall also be subject to these Terms. You can review the most current version of the Terms at any time on this page. Our online sale of goods and services is hosted by a third party, Shopify, Inc. (“Shopify”). Shopify provides the online e-commerce platform that allows us to sell our products and services to you. SECTION 3: ORDER ACCEPTANCE AND CANCELLATION
You agree that your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details of the items you ordered.
SECTION 4: ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
The information on this Site may contain errors or inaccuracies and may not be complete or current. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice. Please note that such errors, inaccuracies, or omissions may relate to product description, pricing, and availability. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is mispriced, we may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Any reliance on the material on this Site is at your own risk. This Site may contain certain historical pricing and product information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our Site. You agree that it is your responsibility to monitor changes to our Site.
SECTION 5: PRICES AND PAYMENT TERMS
Prices posted on this Site may be different than prices offered by us at the store located in the Metropolitan Nashville Airport or displayed on others websites controlled by us. All prices, discounts, and promotions posted on this Site are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total, and will be itemized in your shopping cart and in your order confirmation email. We strive to display accurate price information. However we may, on occasion, make inadvertent typographical errors, inaccuracies, or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences. We may offer from time to time promotions on the Site that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern. We reserve the right at any time to modify or discontinue the products offered for sale on the Site without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Site. Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order. We accept Visa, MasterCard, AMEX and Discover for all purchases. You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order.
SECTION 6: AVAILABILITY OF PRODUCTS OR SERVICES
Certain products or services may be available exclusively online through the Site. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy, which is set forth in more detail Section 10 of these Terms. We attempt to be as accurate as possible. However, we do not warrant that product descriptions or other content on this Site is accurate, complete, reliable, current, or error-free. If a product offered by us itself is not as described, your sole remedy is to return it in unused condition. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the service will be corrected.
SECTION 7: ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address and/or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
SECTION 8: SHIPMENTS; DELIVERY; TITLE AND RISK OF LOSS
We will arrange for shipment of the products to you. Please check the individual product page for specific delivery options. You will pay all shipping and handling charges specified during the ordering process. Shipping and handling charges are reimbursement for the costs we incur in the processing, handling, packing, shipping, and delivery of your order. Title and risk of loss pass to you upon our transfer of the products to the carrier/delivery. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. Please note that delivery date estimates are not a guaranteed delivery date for your order. Shipments to some areas may take longer due to the frequency of deliveries to the delivery zip code, delays in inventory or packaging, transit time to the delivery provider, and transit time to the delivery address.
In the event that we make an express promise to deliver an order within a certain time, we will provide reasonable notification to you if we are unable to fulfill the order in the promised time, and will provide you with further information regarding the delay and your options.
By submitting an order on the Site, you agree that your credit card will be charged in full for the balance of your order at the time the order is submitted.
Title to products which you purchase on the Site, and all associated risk of loss, passes to you upon our delivery of the products to the shipment carrier. In the event that a product return is necessary, title and risk of loss remains with you until the product arrives at our facility.
SECTION 9: VOID WHERE PROHIBITED
We reserves the right to limit, in its sole discretion, the provision and quantity of any feature, product or service to any person or geographic area. Any offer for any feature, product or service made on the Website is void where prohibited. If you choose to access the Site from outside the United States, this is on your own initiative and you are solely responsible for complying with applicable local laws.
SECTION 10: RETURNS AND EXCHANGE POLICY
All returns will be for exchange or store credit only.
Unwashed, unworn and unused merchandise may be returned within 30 days of purchase date. Original tags must be attached. Items smelling of perfume, marked with makeup, showing signs of wear or with traces of animal hair are not valid for return. Shipping charges will not be refunded, unless we made a shipping error.

Once returned item(s) is/are received, your item will be processed within 3-5 business days. If returned merchandise is deemed to be in returnable condition, you will have the option to exchange or be issued a store credit equal to the price of the returned item(s), including sales tax, minus the cost of shipping.
Once the return is processed, if you select a store credit, you will be emailed a gift card code in the full amount of your store credit. Electronic gift cards cannot be refilled and will only expire once the funds have been depleted.

SECTION 11: MANUFACTURER’S WARRANTY AND DISCLAIMERS
We do not manufacture or control any of the products or services offered on our Site. The availability of products or services through our Site does not indicate an affiliation with or endorsement of any product, service or manufacturer. Accordingly, we do not provide any warranties with respect to the products or services offered on our Site. However, the products and services offered on our Site are covered by the manufacturer’s warranty as detailed in the product’s description on our Site and included with the product. To obtain warranty service for defective products, please follow the instructions included in the manufacturer’s warranty.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. IN NO CASE SHALL METROPOLITAN NASHVILLE AIRPORT AUTHORITY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, INTERNS, CONTRACTORS, THIRD PARTY VENDORS, SUPPLIERS, SERVICES PROVIDERS, OR LICENCORS BE LIABLE TO YOU OR ANY OTHER THIRD PARTY ON YOU BEHALF FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OR ANY OF THE SERVICE OF ANY PRODUCTS PROCURED USING THE SERVICE OR FOR ANY OTHER CLAIM RELATED IN ANY WAY ARISING OUT OF YOUR USE OR ANY THIRD PARTY ON YOUR BEHALF’S USE OF THE SITE, THE SERVICES OR ANY PRODUCT INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SITE, THE SERVICE, PRODUCT OR ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE BY THE SERVICE, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.OUR SOLE AND ENTIRE MAXIMUM LIABILITY AND YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCTS AND SERVICES YOU HAVE ORDERED THROUGH OUR SITE OR OTHERWISE TO THE MAXIMUM EXTENT PERMITTED BY LAW.
SECTION 20: GOODS NOT FOR RESALE OR EXPORT
You represent and warrant that you are buying products or services from the Site for your own personal or household use only, and not for resale or export. You further represent and warrant that all purchases are intended for final delivery to locations within the US.
SECTION 21: PRIVACY
We respect your privacy and are committed to protecting it. Our Privacy Policy governs the processing of all personal data collected from you in connection with your purchase of products or services through the Site.
SECTION 22: DISPUTE RESOLUTION AND BINDING ARBITRATION
YOU AND METROPOLITAN NASHVILLE AIRPORT AUTHORITY ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION. ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS OR SERVICES THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.
The arbitration will be administered by the American Arbitration Association (”AAA”) in accordance with the Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified by this Section 22. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this section. The arbitrator will have exclusive authority to resolve any dispute relating to arbitrarily and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. You may elect to pursue your claim in small-claims court rather than arbitration if you provide us with written notice of your intention to do so within 60 days of your purchase. The arbitration or small-claims court proceeding will be limited solely to your individual dispute or controversy.
SECTION 23: INDEMNIFICATION
You agree to indemnify, defend and hold harmless Metropolitan Nashville Airport Authority and its subsidiaries, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or any of the other terms these Terms incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 24: FORCE MAJEURE
We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.
SECTION 25: SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

28 A. To You. We may provide any notice to you under these Terms by: (i) sending a message to the email address you provide or (ii) by posting to the Site. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
28 B. To Us. To give us notice under these Terms, you must contact us as follows: by personal delivery, overnight courier, or registered or certified mail to Metropolitan Nashville Airport Authority. Notices provided by personal delivery will be effective immediately. Notices provided by or overnight courier will be effective one business day after they are sent. Notices provided by registered or certified mail will be effective three business days after they are sent.
SECTION 29: TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use the Site, or when you cease using our Site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Site (or any part thereof).
